IIAInvestor–State Disputes: Prevention and Alternatives to Arbitration

18 Aug 10 - A new UNCTAD publication explores alternatives to investment treaty arbitration and finds that resolving disputes through negotiation or amicable settlement such as international conciliation or mediation and the use of dispute prevention policies can offer promising alternatives. The study encourages States, investors, legal practitioners, arbitration institutions and international organizations to further consider these methods of solving disputes in the context of international investment agreements and investment disputes emerging in the future.  More >>

26 May 10 - In 2009, the number of known treaty-based investor–State dispute settlement cases filed under IIAs continued to grow. Tribunals rendered significant awards on issues relating to the definition of investment, most favoured nation treatment, expropriation and fair and equitable treatment. The new IIA issues note reviews the most recent developments in investor–State disputes and the significant awards rendered in 2009.  More >>


hspace=6The role of international investment agreements in attracting foreign direct investment to developing countries

17 Dec 09 - A new report discusses international investment agreements (IIAs) as a tool to boost FDI. The study concludes that - within their limited role as foreign investment determinants - IIAs can influence a company´s decision where to invest. This impact is generally stronger in the case of preferential trade and investment agreements than with BITs. However, IIAs need to be embedded in broader FDI policies, covering all FDI determinants and carefully balancing the costs and benefits of such agreements.  More >>
