UNCTAD-Commonwealth Secretariat Workshop on Elements of National Sui Generis Systems for the Preservation, Protection and Promotion of Traditional Knowledge, Innovations and Practices and Options for an International Framework
Geneva, Switzerland. 4-6 Feb 2004
Objectives:
1. To identify a menu of actions and policies which could be included in holistic national systems for the preservation, protection and promotion of traditional knowledge, innovations and practices (TK). This list would serve as a practical guide for countries wishing to develop holistic national sui generis systems. It could, for example, facilitate initial multistakeholder consultations.
Holistic sui generis systems could aim at:
a. preserving TK
b. protecting TK against misappropriate use (including PIC and IPR instruments)
c. promoting the further development of TK systems and TK-based innovation
d. integrating TK into development strategies (also related to c and e)
e. promoting the sustainable use of TK (including appropriate commercialization and benefit sharing)
2. To explore options for an international framework for the protection of TK.
Discussions of options and strategies for TK-rich countries including:
a. actions which could be taken in the relevant international forums, particularly WTO, WIPO, CBD and FAO.
b. possibilities for cooperation, particularly among TK-rich countries, aimed at mutual recognition of national sui generis systems
The meeting will bring together in an informal setting experts with a range of perspectives and expertise (environment, trade, indigenous, development, intellectual property, capacity building etc.) Experts participate in their personal capacity. Participants will be expected to prepare short notes concisely outlining their ideas and proposed actions on one or more of the topics above. In addition, they are welcome to provide information on their national experiences or areas of expertise as background information for the meeting. Discussion papers are being prepared by Carlos Correa, Peter Drahos and Graeme Dinwoodie.
